When I speak before groups, people are often surprised when I mention that their parents' estate plan could create big problems for them. One main area that your parents' estate plan could create a headache for you is the health care directive. If thier health care directive (also know as a living will) has not been updated to comply with the relatively recent HIPPA rules, you may not be able get information about your parent(s) from doctors in their time of need. Also, the health care directive may be missing key instructions that lead to dissent among family members about the best choices to make in a health crisis.

Also, if your parents have not done estate planning, it can lead to a mess for the family because a judge will have to decide how to distribute assets and it may not be what your parents would have wanted.
